A Few Thoughts on Dover

As most readers of this blog now know, the judge in the Pennsylvania court case over Intelligent Design has ruled against the school board and declared that they violated the first amendment establishment clause by requiring that a statement be read stating that there are alternatives to Darwinian evolution such as ID.
There is of course some disappointment in this ruling. I personally do not know that much about the judge or the school board members, so it is difficult to talk of motives on either part.
I have a few problems with the ruling. The first is the fact that the judge states he ruled as he did because the board acted from religious motives. He states, ID “cannot uncouple itself from its creationist, and thus religious, antecedents”. Unfortunately, the judge is guilty of fallacious reasoning here. He blatantly misrepresents ID. In a sense, it is saying because they are not allowed to act according to their worldview. Every person’s decisions and actions are dependent on their worldview, and every worldview encompasses beliefs about God and spirituality. It is well established that many Darwinists are atheists (including Dawkins). Certainly, his worldview will motivate certain actions. What I am trying to say is this: It is a fallacy to dismiss an argument based on the motives of the one offering the argument. Either the argument is reasonable, or not. One’s motives are of little concern over the issue of whether the weaknesses of Darwinism should be addressed and whether students should be alerted to the existence of other viewpoints.
Second, he stated ID is not science because it cannot be verified or falsified through normal scientific methods. Perhaps he would like to tell us how Darwinism is falsifiable. To many scientists, it is not. I guess this makes Darwinism unscientific and it should be relegated to philosophy class. Falsifiability can be difficult for any scientific theory describing how things have occurred in the past. One can always modify one’s theory to incorporate new discoveries. ID seems to me to be blatantly verifiable in the specified and irreducible complexity found in our world. Everyday people examine evidence to see whether the object of their study happened by chance or by some intelligent cause (Archeologists, Criminologists, etc).
Another issue is the overblown extension of the establishment clause excluding any reference to God as establishing religion. This decision just takes it one step further. The statement to be read to the students made no reference to God or any particular church. How can this be construed as an establishment of religion on the government’s part?
Finally, the response of the Discovery Institute is helpful:
“A legal ruling can’t change the fact that there is digital code in DNA, it can’t remove the molecular machines from the cell, nor change the fine tuning of the laws of physics,” added West “The empirical evidence for design, the facts of biology and nature, can’t be changed by legal decree.”
“In the larger debate over intelligent design, this decision will be of minor significance. As we’ve repeatedly stressed, the ultimate validity of intelligent will be determined not by the courts but by the scientific evidence pointing to design.”

Review of Luthers The Bondage of the Will

I finished Martin Luther’s The Bondage of the Will last night and I thought I’d take a minute to do a review. The book was written as a reply to Erasmus’ Diatribe Concerning Free Will and is divided into four main sections. In the first, Luther discusses Erasmus’ preface and introduction, noting how he defines his terms and what he sets out to prove. In the second, he discusses Erasmus’ biblical and theological arguments for free will. In the third, he discusses Erasmus’ treatment of biblical texts that are commonly used to argue against free will, and in the fourth he attempts to give his own biblical defense against free will.
The first thing that surprised me about the book is just how little things have changed in the Calvinism vs. Arminianism debate (although of course it wasn’t known as that back then). The same texts are treated and many of the same arguments are given by both sides. More than once I had to remind myself that I was reading a book written about 450 years ago and marvel at how little has changed. It was also interesting for me to read something written by Martin Luther simply because he is a man who I’ve heard so much about but who never took on a personality until I read this (and watched Luther ).
Luther’s writing itself is very thorough, although in many places repetitive. Many of his arguments were quite strong and he had an obvious mind for logic and knowledge of the Scriptures. Nevertheless, many times he took his arguments to prove much more than they did, and much of his writing seems arrogant and insulting to Erasmus (although he realized this was a flaw of his and apologized for it in his conclusion). Erasmus sought to prove that the human will can by some small effort prepare itself for grace, and so far as Luther argued against this conclusion and that the will is completely helpless in issues pertaining to salvation, I agreed with him. Unfortunately, he went beyond this to argue that everything that happens does so by necessity, which is where I would differ with him, for reasons I won’t go into here. Suffice it to say, I don’t think he argued conclusively for that fact.
I would definitely not reccomend this book as an intro into the debate on the freedom of the will or issues regarding the Calvinism vs. Arminianism debate, but for anyone with an introduction to these issues who seeks a historical background and to acquaint themselves with some of the writings of the reformation, this book is an enjoyable read. The historical introduction by J.I. Packer and O.R. Johnston in the Baker edition alone was worth the price of the book (for me anyway).
The last thing I wanted to discuss, and the thing that surprised me most, was how central Luther thought the question of the bondage of the will and God’s sovereignty in salvation was to the reformation. In a time when most Protestants don’t believe in the reformation doctrines later formalized into the five points, and we are taught that the reformation mainly occured because of indulgences and the abuse of the Pope, I was surprised to read this from Luther’s pen (from his concluding marks to Erasmus):
I give you hearty praise and commendation on this further account - that you alone, in contrast with all others, have attacked the real thing, that is, the essential issue. You have not wearied me with those extraneous issues about the Papcy, purgatory, indulgences and such like - trifles, rather than issues…you, and you alone, have seen the hinge on which all turns, and aimed for the vital spot.

1st Weekly Christian Poetry Corner

I was reading this week’s Weekly Dose of Spurgeon at Pyromaniac and I thought it would be neat if this blog too had a weekly tradition of sorts. Inspiration struck and I now proudly present the first weekly Christian poetry corner. It is my plan to here post classic Christian verse for enjoyment and reflection every Monday. I suppose that I must make the disclaimer that I will of course not agree with much of the theology that was held by many of the poets whose works will be displayed here, but will only post poetry that in itself is unobjectionable (to me anyway). With that taken care of, here is one of my favorites by Gerald Manley Hopkins, to whom I was introduced by my pastor, called God’s Grandeur:

I Survived an Abortion Attempt

The BBC news interviewed a young lady named Gianna Jessen, whose mother tried to obtain an abortion at 7 1/2 months of pregnancy. It is a moving story of an abortion gone wrong. Gianna suffers from cerebral palsy as a result of the events of her birth. She states:
“Being almost murdered in the womb and then having to struggle from the moment I was delivered means I have a love of life and a joy of life.”
As stated by Citra Abbott:
“Gianna is bearing witness to the humanity of the unborn child and to the right to life of every human being.”

Atheism, Evolution, and the Ad Populum Fallacy

JDHURF commented on my last post. I appreciate hearing from those with opposing viewpoints. He disagreed with my assertion that Darwinian evolution logically leads to atheism. It is interesting that his support for his disagreement falls prey to the same error which Dawkins made. His reasoning is fallacious. The fallacy he makes is called the Ad Populum Fallacy, or the appeal to popularity. Here is how the fallacy is structured in this case:
1) Many people are theists and Darwinian evolutionists
2)Therefore theism and Darwinian evolution are logically compatible.
Once again, the fact that certain people hold to two separate beliefs does not imply their truth or rationality, or that they are logically compatible. Granted, there are those who state they hold a theistic view, yet embrace Darwinism. I would argue that there viewpoint is irrational. By definition, Darwinism makes no allowance for the supernatural. We are as we are due to exclusively natural and materialistic causes. Theism, by definition, implies that God is active in our world. One cannot rationally have it both ways. To hold that both Darwinism and Theism is true is to believe a contradiction.
The commenter also asked for statistical evidence to support my claim that moral relativism naturally flows from evolution. He is asking for me to commit the ad populum fallacy. It matters not whether a thing is believed by no one, a few, many, or everyone. It is rational and true based on the logical merits of the claim. I would be interested in hearing how evolution supports any viewpoint other than moral relativism. Darwinism cannot base its morality on any moral absolutes, as their are no transcendant moral principles. We are what we are by chance, and there are no compelling reasons for one to live his life in any way other than how he sees fit.

Does Atheism Follow from Evolution?

Telic Thoughts has a post referencing a recent interview of Richard Dawkins with Beliefnet’s Laura Sheahen. I found the interview very revealing. Among the questions asked was this one: Is Atheism the logical extension of believing in evolution? Here’s the answer:
They clearly can’t be irrevocably linked because a very large number of theologians believe in evolution. In fact, any respectable theologian of the Catholic or Anglican or any other sensible church believes in evolution. Similarly, a very large number of evolutionary scientists are also religious. My personal feeling is that understanding evolution led me to atheism.
I hope this is not Dawkins’ best answer to the question. In fact, he did not answer the question at all. His answer sidesteps the issue by stating, “Well, some people believe in God and evolution, so atheism must not logicaly follow from evolution”. The question was not whether some folks claim they believe in both. I may believe a contradiction, but that does not make it logical. I may believe that Elvis died in 1977 and that I saw him at the mall today, but that is not logical. The question was does one’s belief in evolution logically lead one to atheism. The answer is darwinian evolution does. Because many people believe something does not make it logical. According to Dawkins, one must be either be unrespectable or insensible to doubt evolution.
I am not stating that in order to be a Christian one cannot believe in some sort of evolution. One could certainly believe that God chose to use some sort of evolutionary process to bring about life as we know it. Many in the intelligent design community are both Christian and believe God did use evolution to some degree. And some ID’ers are not Christian at all.
Darwinism however excludes the supernatural. It is a purely random, undirected, unguided process in which all there is is matter. The logical extension of such a naturalistic view about life is atheism. Dawkins was asked, also, about those who feel the answer of God is satisfying? His answer:
Well, of course it is. Wouldn’t it be lovely to believe in an imaginary friend who listens to your thoughts, listens to your prayers, comforts you, consoles you, gives you life after death, can give you advice? Of course it’s satisfying, if you can believe it. But who wants to believe a lie?
When asked about the despair many feel when confronted with the consequences of darwinism, he answered:
If it’s true that it causes people to feel despair, that’s tough. It’s still the truth. The universe doesn’t owe us condolence or consolation; it doesn’t owe us a nice warm feeling inside. If it’s true, it’s true, and you’d better live with it.
When asked about the top sources for optimism and hope in a naturalistic or materialistic worldview…
I think there is something glorious in the universe, in contemplating the Milky Way galaxy, in contemplating the fact that this is only one in billions of galaxies, contemplating the fact that at the beginning of the 21st century, humanity really has gone a very long way toward understanding the universe in which we live and the life form of which we are a part. I find that a truly inspirational thought.
Obviously, there are other things having nothing to do with science—music, poetry, sex, love. These are all things that make life, to me, extremely worth living.
Then there’s the added fact that it is the only life we’re ever going to get. Don’t kid yourself that you’re going to live again after you’re dead; you’re not. Make the most of the one life you’ve got. Live it to the full.
I write all this because I am so frustrated by hearing well-meaning Christians who publicly wonder what the big deal is regarding intelligent design. The big deal is that young people who are taught Darwinism as truth will logically reach the conclusion reached by Dawkins. Although Dawkins’ answer to the question of atheism following from evolution was illogical, his own worldview follows perfectly from evolution. If Darwinism is true, we would all do well to follow his advice given in the previous quote. Atheism and moral relativism is the logical conclusion. Do whatever makes you happy. There is no ultimate right or wrong.

A Personal Note of Rejoicing

    The last few days have been absolutely wonderful for me and God has blessed me with so much to be thankful for. On Thursday my wife finished her finals and we went out to watch Pride and Prejudice to celebrate. The movie was great and I left the theater feeling happier than I think I have ever been after watching a movie. I felt refreshed and in love, amazed that at barely 21 I am already married to such a wonderful and beautiful Christian woman. I remember walking to the car and the moon was bright and full and the clouds were an eery but beautiful silver color against the otherwise black sky and at the moment when I was more happy and more at peace than I can ever remember being, I felt more strongly than ever the sense that there is something more and I longed for the glory of God. On the next day, I had my last final and afterwards found out that I got the job on campus that I wanted (and needed) for next semester. I don’t know if anyone I know actually reads this blog, but if you do, thanks for your prayers.
    With the semester now over and my first day of work on Jan. 3, I have two weeks to relax and get some reading done and perhaps start on an article on my version of incompatibilist Calvinism that I’ve been wanting to write. When school resumes, I’m taking Biblical Hebrew II, Ethical Theory, Philosophy of Mind, and Philosophy of Music and I can honestly say that I’m excited about every class. In addition to all this, there are only 8 days until Christmas! Life is good.

Inference to the Best (Naturalistic?) Explanation

I have long been impressed with the inference to the best explanation approach to proving the existence of God. This has been used to some degree by many Christian philosophers. When looking at our universe, what is the best explanation. Many have concluded that the Christian God is the best explanation. The God of the Bible and the Christian worldview makes the most sense of the world to me. The best explanation for the physical world we live in is God. The best explanation for man’s sense of morality, the existence of good and evil, is the existence of the Christian God.
Darwinism is a form of inference to the best explanation. As explained by Moreland and Craig in Philosophical Foundations for a Christian Worldview:
Darwinists recognize that the theory represents a huge extrapolation from the data, which support micro-evolutionary change but do not provide evidence of macro-evolutionary development. They further freely admit that none of the evidence, taken in isolation, whether it be from microbiology, paleogeography, paleontology, and so forth provides proof of the theory. But their point is that the theory is nonetheless the best explanation, in virtue of its explanatory power, scope and so on.
The problem with Darwinism is it is not the best explanation. It may be the result arrived at by the inference from the best “naturalistic” explanation. Most ID adherents would probably grant this to be true. However, Darwinists limit possible explanations by requiring they be naturalistic. When one places limits on what can qualify as an explanation, one runs the risk of arriving at a less desirable explanation. Or worse than that, with the wrong explanation. Perhaps, this is what Darwinism fears from the ID community. Darwinists run the risk that their explanation will be judged to be inferior to the ID explanation.

Will America Be Secularized?

Stand To Reason has a post today about an article written by John Derbyshire at the National Review. The discussion is about whether or not religious folks take their religion seriously. The answer seems to be that in western Europe the answer is no. Comparatively speaking, Americans still do take their religion seriously.
I have been listening to a set of lectures by Dr. Patrick N Allitt of Emory University on the religious history of America. He talks about the theory of secularization which holds that as societies become more and more industrial, religion plays less and less a role. They become more secular and less religious. Professor Allitt (who is English) speaks a lot about the uniqueness of America in the western world. The United States is about the only western industrialized nation that still really considers itself a Christian nation. Sociologists have mostly had to abandon the theory of secularization that was so popular in the nineteenth and early twentieth centuries. Certainly, there was prior reason to believe the theory was true as country after country in Europe succumbed to secularism. It was only a matter of time until the United States also yielded. Since then, Marxism has been discredited, and the United States has withstood the supposed juggernaut of secularism.
The articles at STR and NRO both talk about the disconnect that has developed between the religious life and secular life of Christians. Though the majority of Englishmen consider themselves Christian, less than 5% actually attend church. They are Christian in name only. They are secular Christians whose faith really holds no truth value. Their lives are governed by secular principles of relativism and materialism. Unfortunately, although the United States has resisted this move thus far, secularism continues to make inroads into Christianity.
As I blogged a few days ago, this is why ID and Darwinism matters. We cannot succumb to a materialistic worldview and allow the secular to set the ground rules regarding what is real and true. If naturalism is true, then all Christians are deluded and wasting their time going to church. Unfortunately, many who call themselves Christians in America are giving in to that materialistic view of truth. That is why many Christians embrace the view that abortion is okay, or that homosexuality is a morally acceptable lifestyle. It is why cheating, adultery, and premarital sex is okay. So far, we have prevailed over secularization. We will only continue to do so as Christians fight against naturalism and materialism and all the principles which naturally follow from that worldview.

  • Case mishandled says FELA claimant, sues lawyer

    Robert Loehr filed a legal malpractice suit against Eric Holland, Dennis Rathmann, Bruce Cook and the law firm of Cook, Ysursa, Bartholomew, Brauer and Shevlin claiming his Federal Employees Liability Act (FELA) lawsuit was mishandled.

    According to Loehr, he sustained injuries on June 12, 2000, as a result of a collision between a locomotive owned by Norfolk Southern Railway and a passenger vehicle driven by Christopher Campbell.

    Loehr claims that on March 29, 2001, Dennis Rathmann or Eric Holland of Rathmann & Francis filed a lawsuit on his behalf in St. Louis against the railroad and Campbell.

    According to the complaint, Holland or Rathmann sent a letter offering to settle the lawsuit for $970,000 causing the railroad to send an offer that Holland and Rathmann advised Loehr to reject because it was too low.

    Loehr claims that sometime after Jan. 23, 2002, Holland had a meeting with him in Belleville where he made clear with Holland that he wanted the case handled by attorney Francis who was leaving the firm that employed Holland.

    According to Loehr, Holland convinced him to change his mind and then authorized Holland and his firm to prosecute his case against the railroad and Campbell.

    Loehr claims on Jan. 23, 2003, he wrote a letter to Holland ending the attorney-client relationship with Holland and Rathmann, then hired Bruce Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin to handle his suit.

    Cook sent a letter to Holland on Dec. 12, 2003, instructing Holland to voluntarily dismiss Loehr’s suit, causing Holland to file the pleading on Dec. 19, 2003.

    Then, Cook filed suit in Madison County on Feb. 17, 2004, against the railroad and Campbell, however Circuit Judge Philip Kardis dismissed the suit as time barred.

    After the dismissal of the second lawsuit, Cook sent a letter to Patrick O’Brien requesting that he file a lawsuit on Loehr’s behalf in St. Louis City, however that suit was also dismissed as time barred by Judge Ohmer permanently foreclosing on Loehr’s ability to collect any compensation from the railroad.

    Loehr claims the defendants caused his first lawsuit in St. Louis to be voluntarily dismissed when he knew that the dismissal would have the effect of permanently foreclosing his chance to recover monetary damages from the railroad unless promptly remedied and failed to file motions to nullify the effect of the dismissal.

    Seeking damages in excess of $100,000, Loehr is represented by David Nelson and John Fredrick, Jr. of Nelson and Nelson in Belleville.

    After $43 million verdict, Ford asking for new trial

    Attorneys usually file complaints and take them to trial. The Lakin Law Firm of Wood River reversed the process by winning a trial and then filing the complaint.

    Attorney Charles Chapman of the Lakin firm filed an amended complaint Nov. 6 for Dora Jablonski and her son John Jablonski Jr., more than six months after a Madison County jury returned a $43 million verdict in their favor against Ford Motor Company.

    “During the course of the trial, plaintiffs sought and were granted leave to amend the pleadings to conform to the proof,” Chapman wrote. “The filing of this amended complaint is merely a continuation and finalization of that process.”

    Ford Motor Co., after trying for eight months to persuade Circuit Judge Andy Matoesian to order a new trial, has asked the Fifth District Appellate Court to order a new trial.

    According to Ford, Matoesian let the Jablonskis amend the complaint during trial. He even granted leave to amend it at the close of evidence, in a conference on jury instructions.

    On April 19, jurors awarded $23.1 million to Dora Mae Jablonski, and $5 million to her son. Jurors awarded $15 million in punitive damages.

    The amended complaint that Matoesian allowed during jury instructions arrived at the courthouse May 6, 17 days after the verdict.

    Ford moved May 27 for a new trial, arguing that Matoesian prejudiced jurors in deliberations over a collision that killed John Jablonski Sr., and injured his wife.

    The gas tank of their 1993 Lincoln Town Car exploded when a rear end crash propelled a wrench from the trunk into the tank.

    Ford argued that Matoesian improperly excluded evidence about the negligence of the driver Ford blamed for the crash, Natalie Ingram.

    “The notion that Ford was responsible let alone to the tune of $43 million for a rear end collision caused by a criminally negligent driver who rammed into plaintiffs at a speed in excess of 60 miles per hour is offensive to notions of common sense,” wrote Ford attorney Dan Ball, of Bryan Cave in St. Louis.

    Ball argued that Matoesian should have instructed jurors to allocate fault between Ford and Ingram.

    Plaintiff’s counsel said in their opening statement that Ingram accepted responsibility, but plaintiffs presented no evidence for that, Ball wrote.

    He wrote that Matoesian improperly prevented Ford from telling the jury that the crash involved four cars, as evidence of Ingram’s excessive speed.

    Ball also argued that Matoesian allowed irrelevant evidence. He wrote that one exhibit related to a 1975 Mercury and another related to a Thunderbird crash test.

    The verdicts were “induced by the admission of incompetent, irrelevant and speculative evidence,” he wrote.

    Ball objected to Matoesian’s decision to allow an amended complaint during trial. He especially objected to the decision after trial to allow the Lakin firm to amend again.

    He also argued that Matoesian gave improper instructions to the jury and refused to give proper instructions.

    “Ford did not and could not receive a fair trial, as the instructions given, taken as a whole, did not state the applicable law fairly and accurately, and were so unclear as to mislead the jury and prejudice Ford,” he wrote.

    Ball called the award of punitive damages “palpably absurd” and “so grossly excessive as to show passion, partiality or corruption on the part of the jury.”

    He wrote that, “punitive damages are not intended to drive the defendant out of business or to threaten a defendant’s financial stability.”

    The trial showed Ford was not aware of any incident in the U.S. in which trunk contents punctured a fuel tank. And, Ford complied with standards of the National Highway Transportation Safety Administration, he wrote.

    “Punishing Ford for selling a 1993 Town Car reasonable people could conclude was safe a belief supported by compliance with NHTSA standards and confirmed by NHTSA investigation reports would be fundamentally unfair and would violate the notice requirement of the United States Constitution,” Ball wrote.

    He called the system of punitive damages in Illinois “arbitrary and discriminatory.” Lack of guidelines, he wrote, “inevitably leads to variations in result with no rational basis for differentiation.”

    Six days after Ball moved for a new trial, the Lakin firm filed another amended complaint.

    In August, Matoesian heard arguments on Ford’s motion for a new trial. He took it under advisement.

    In September, Chapman moved again for leave to amend the complaint. Matoesian allowed it. Chapman filed an amended complaint Nov. 6.

    On Nov. 21, Matoesian denied Ford’s motion for a new trial.

    Ford posted appeal bonds Dec. 16. According to the case docket, Ford filed notice of appeal Dec. 20.

    At press time, the notice had not made it to the case file.

    Niece claims aunt suffered head injuries at St. Paul’s

    Vergia Weaver claims her aunt Annie Mae Donald died from head injuries sustained in a fall at St. Paul’s Home nursing home in Belleville, in a lawsuit filed Dec. 7 in St. Clair County Circuit Court.

    Weaver claims her aunt suffered subdural hematomas on Nov. 7, 2003, and died on Dec. 7, 2003.

    According to the suit, Weaver claims St. Paul’s failed to transfer her aunt to a hospital facility when her mental status deteriorated, allowed her aunt to ambulate and walk without supervision and failed to obtain a doctor’s order to restrain her aunt.

    She claims that prior to her death at St. Paul’s home, her aunt suffered great pain and anguish.

    Weaver also claims she has suffered a pecuniary loss, loss of services, consortium, companionship, comfort, support, medical, and funeral and burial expenses.

    Represented by Phillip Cervantes and Jennifer Suttmoeller of St. Louis, Weaver is seeking damages in excess of $50,000.

    ConocoPhillips sued for worker’s loading dock fall

    Paul Hauck filed a personal injury suit against ConocoPhillips in Madison County Circuit Court Dec. 16, seeking damages in excess of $50,000 for injuries he sustained while loading his truck at the Roxana refinery and OMS loading facility.

    Hauck claims that on Dec. 17, 2003, ConocoPhillips carelessly and negligently caused and permitted its premises to become and remain in a dangerous condition for people loading odorized mineral spirits, or OMS, onto tankers or trucks.

    According to Hauck, he parked his truck at the OMS facility, exited his truck and began to walk on the loading dock when he fell on a slippery area.

    Hauck claims ConocoPhillips failed to: properly clear and remove OMS from a loading dock, warn drivers of dangers or make necessary repairs.

    He also claims ConocoPhillips allowed a condition to exist which involved an unreasonable risk of harm to exist on its property.

    According to Hauck, he has suffered permanent injuries to his wrist and other parts of his body, which caused him to suffer great pain and mental anguish, lost wages and has been compelled to obligate himself for medical aid and attention.

    Hauck is represented by Ben Beyers of Bilbrey and Hylla in Edwardsville.

    The case has been assigned to Circuit Judge George Moran.

    St. Louis Cab named in St. Clair personal injury case

    Steven Reed of St. Louis filed a personal injury suit against St. Louis County Cab and its employee, Jackson Kimangu, in St. Clair County Circuit Court, seeking damages from an auto accident in East St. Louis.

    In the Dec. 5 suit, Reed claims he was driving his motorcycle at the intersection of Caseyville Avenue and 25th Street on July 5, when Kimangu, driving for the cab company, failed to yield and pulled into his path.

    According to the complaint, Kimangu failed to: keep a proper lookout ahead and laterally, signal warning of the approach or yield the right of way.

    Reed claims that his entire back, pelvis, left foot, face, neck and head along with all the bones, muscle, ligaments, tendons, blood vessels, and cartilages were severely bruised, contused, lacerated, cut, torn, swollen, mashed, narrowed, wrenched, dislocated, sprained and rendered stiff.

    The suit also claims Reed’s entire nervous system was severely shocked and deranged and he suffered and will continue to suffer great physical pain and mental anguish and that the injured parts of his body that have been greatly diminished.

    Represented by Jerry Crowder of Brown and Crouppen in St. Louis, Reed is seeking damages in excess of 100,000.

    “The carelessness and negligence of St. Louis Cab and their agent, Jackson Kimangu, was the approximate cause of the injuries to Steven Reed.”

    Excessive dose of allergens prompts action against ENT

    Sharon Weaver-O’Brien filed a medical malpractice suit against Swansea based Ear, Nose & Throat Institute of Southern Illinois in St. Clair County Circuit Court Dec. 9, seeking damages in excess of $250,000.

    Weaver-O’Brien also names Murray McGrady, M.D., Peter Selz, M.D. and Cindy Varnum, R.N.

    Weaver-O’Brien claims that on Dec. 12, 2003, she received an allergy test at the institute at the recommendation of her regular doctor, McGrady, when Varnum, under the supervision of Selz, negligently administered an excessive dosage of allergens causing her to have an anaphylactic reaction.

    In response to the anaphylactic reaction, Selz failed to timely and properly administer efficacious medicines and oxygen to ameliorate the effects of the extreme allergic reaction, according to the complaint.

    Weaver-O’Brien claims she suffered an extreme allergic reaction, hospitalization, medical bills, emotional distress, pain and suffering, allergic hypersensitivity, loss of enjoyment of life and loss of income and earning capacity.

    John O’Brien, Sharon’s husband, claims as a result of his wife’s personal injuries he has suffered damages to his marital relations and has lost the services, care, comfort, society and companionship of his wife.

    Sport Trac roll-over leads to suit against Ford

    A St. Clair County man who claims he was left paraplegic after a roll-over accident in his 2002 Ford Explorer Sport Trac is suing Ford Motor Co. for at least $400,000.

    Jeffrey Rush claims he swerved to avoid an object in the road while driving south on U.S. Highway 77 in Milford, Kan. on Oct. 5, 2004, when the accident occurred.

    The St. Clair County suit filed Dec. 9 claims Ford and co-defendant TRW Inc. were negligent for the vehicle’s defective design.

    According to Rush, the vehicle’s track was not sufficiently wide in light of its high center of gravity. He also claims the Explorer was not equipped with anti-roll stability control, side curtains or safety canopies.

    The suit also alleges the vehicle was equipped with a tire size that caused it to be unstable and its roof was not sufficiently strong to withstand the forces caused by a rollover.

    “As a result of the defective and unreasonably dangerous condition, Rush suddenly turned the vehicle to avoid an object in the road and vehicle rolled over causing Rush to be tossed to and fro and up against the driver’s hard surfaces,” the complaint states.

    Rush claims that the seatbelts, manufactured by co-defendant TRW, were defectively designed because they failed to incorporate pre-tensioning devices that would enable the seatbelts to adequately restrain occupants during a rollover.

    He also claims injuries to his neck, limbs and torso, and he has suffered great pain and mental anguish, became liable for large medical expenses and lost wages.

    Amy Rush claims Jeffrey’s injuries have caused her to suffer a loss of consortium, including a loss of services, support and conjugal relations.

    Improperly placed mat culprit in $50k suit against Family Dollar

    A woman who was injured while shopping at the Belleville Family Dollar filed suit against the retailer alleging it failed to use ordinary care to remove an improperly placed mat, which caused her serious permanent injuries.

    Leora Oregon claims that on Dec. 12, 2003, she tripped and fell on a floor mat near the entrance of the store located at 6401 West Main St. in Belleville.

    “All actions of Oregon leading up to her injury were prudent and easily anticipated by Family Dollar,” the complaint states.

    According to the complaint, Oregon suffered serious, permanent and disabling injuries, including a fractured left hip and laceration injuries to her head, skull, neck, body and limbs.

    Oregon also claims she strained or sprained her trunk, neck, back and shoulders, a shock to the central and peripheral nervous systems, severe pain in body and mind, and claims that her injuries are progressive in nature and the use of the injured parts and organs are severely impaired and made painful.

    The suit claims Oregon has incurred medical expenses and has lost wages in an amount not readily ascertainable.

    “Family Dollar knew that in the exercise of ordinary care should have known of the dangerous condition of the premises and failed to warn or correct the dangerous condition.”

    Oregon is represented by Gerald Dunne of Clayton, Mo.

    St. Louis Bread Co. sued over icy fall

    December 22nd, 2005

    Linda Graff filed a personal injury suit against Panera Bread Company in St. Clair County Circuit Court Dec. 12, seeking damages in excess of $50,000 for injuries she allegedly received at a Belleville restaurant on Jan. 31, 2004.

    Panera Bread Co. is the parent company of St. Louis Bread Co.

    Graff claims while she was walking into the restaurant on East Main Street in downtown Belleville, she slipped and fell on ice that was on the walkway near the entrance.

    “Panera owed a duty to Graff to maintain its premises in a non-negligent manner and to keep the walkway clean of any unnatural accumulation of ice and snow,” the complaint states.

    Graff claims Panera allowed ice to be in the walkway where customers would enter and exit without cleaning it up and failed to warn customers of the ice.

    According to the complaint, Graff sustained injuries to her right arm and shoulder, spent money for medical care and has experienced pain and suffering.

    This will be the last post on this weblog.  We have been at it for about 20 months now, and it has been a rewarding experience.  But the technical problems with Radio have proven to be intolerable.  For the second time in a month, we have found that new postings and/or edited postings have not been posted to the site for several days after they were created.  There is no reason that a user should have to accept such a poor level of service. 

    The subscription is good until July 2004, so these pages will be up until then. 

    We may decide to set this site up with another service, and if we do, we will post a pointer here.  For now, though, thank you and good night.

    Two reports in recent days involving forensic evidence disputes:

    Cardiologist: FenPhen Trust Conspired To Destroy Her 

    A physician who was named as a defendant by the Settlement Trustee in the Fen-Phen cases, and accused of falsifying numerous echocardiograms, has filed a counterclaim alleging that:

    Specific cases that she had identified as showing a compensable injury are now being used by the trust to train its examiners to reject legitimate claims, despite the fact that the trust’s own overreads confirmed them as legitimate.

    The dispute arises from an obsolete and unscientific definition of “moderate mitral regurgitation” as used in the Settlement Agreement.  She alleges that she is being targeted because she followed the definition used in the Agreement.  (Source: LexisOne)

    Dog-handler pleads guilty

    Woman admits in Detroit court to planting bones at crimes scenes across Michigan, U.S

    An internationally known handler of a cadaver dog admitted she planted bones and other phony evidence at crime scenes across Michigan and Ohio. Sandra Marie Anderson of Sanford and her Doberman-German short-hair dog, Eagle, participated in hundreds of searches, including at the World Trade Center after September 11 and at mass graves in Bosnia and Panama. Anderson, 43, searched dozens of historical sites — from a Nebraska Native American burial ground to a Mackinac Island golf course, hunting for remains of soldiers killed in 1812.

    But she has admitted she planted evidence for Eagle to find in at least a half-dozen cases. Lawyers for Azizul Islam of Plymouth, convicted in the 1999 murder and dismembering of his wife, have asked for a new trial based on the disclosure.

    Too narrow a view

    Last week, on her radio show, I heard Laura Ingraham repeat a fallacy commonly voiced by those who do not fully understand the First Amendment’s guarantees of free speech.  The free speech guarantee should not apply to pornography, she said (referring to all forms of sexual expression and not just to the much more narrow concept of obscenity) because the Founders intended the free speech clause to protect political speech and certainly did not intend it to protect speech, expression, or conduct describing sexual acts. 

    The fallacy of her position may be demonstrated by considering a couple of hypotheticals.  Suppose that the State of Ohio were to pass a law prohibiting the sale of science fiction novels.  All other forms of fiction would be permitted without restriction, but science fiction would be prohibited outright. 

    Suppose further that the State of Indiana were to prohibit any written or graphic depiction of people eating food, as well as any photos or drawings depicting human mouths, tongues, or lips.  Perhaps the courts would limit such prohibitions to depictions designed to appeal to the esurient interest.

    In each case, there is no aspect of political speech that is involved.  Neither would be protected under the limited concept of freedom of speech that Ingraham envisions.  But both statutes would be clearly unconstitutional, inconsistent with guarantees of free speech as we understand them.

    Cops Kill Man Breaking into Sex Offender’s Home - “Police shot and killed a knife-wielding man attempting to break into the home of a registered sex offender who police warned neighbors might still be abusing children. Authorities on Monday defended their decision to circulate a flier in a Bakersfield neighborhood identifying Vincent Verdile as a registered sex offender even though the information was ‘completely unsubstantiated…’ On Saturday, police shot and killed Gabriel Angel Garcia, who was attempting to kick in Verdile’s front door. Police had not yet established a motive for why Garcia, a 20-year-old neighbor of Verdile, was trying to break into the man’s home. But several weeks ago, Bakersfield police circulated a flier around Verdile’s neighborhood with a picture of Verdile on it and listing his height, weight, hair color and race under a banner that read, ‘Serious Sex Offender…’” - Mercury News (US)

    One of the major objections to a sex offender registry is the possibility that someone will decide to take justice into his own hands.  Perhaps ordinary citizens don’t much care if that happens to a child molester, but the indiscriminate nature of the listings in many states, including our own, mean that the same thing can happen to people guilty of no more than youthful indiscretions.

    Court Of Appeals Orders Child Support From Sex Abuse Victim — A man who was the victim of criminal sexual conduct when he was 14 years old has been ordered by a panel of the Court of Appeals to pay child support to the child conceived as a result of the relations with a married woman.

    The case, Evelyn v Shire, is reported here.   An excerpt:

    Respondent argued that he was the victim of an act of criminal sexual conduct committed by Evelyn because he was fourteen years old when she induced him to have sexual intercourse. He reasoned that because he was under the age of consent, his participation was legally involuntary. This argument confuses two distinct legal concepts. Because of his age at the time of the sexual conduct, the law refuses to permit the adult in the relationship to claim consent as a defense. People v Gengels, 218 Mich 632, 641; 188 NW 398 (1922) (“Proof of consent is no defense, for a female child under the statutory age is legally incapable of consenting.”); People v Bennett, 45 Mich App 127; 205 NW2d 831 (1973) (fourteen-year-old boy incapable of giving legal consent to act of taking indecent liberties). Therefore, even if respondent was a willing participant in the sexual intercourse, Evelyn could still have been charged with, at least, third-degree criminal sexual conduct. MCL 750.520d(1)(a) (victim between 13 and 16 years old).

    However, the issue presented by this case is not Evelyn’s criminal culpability for criminal sexual conduct, or whether respondent was – or could have been – a “consensual” participant in that activity. Rather, we are concerned with whether respondent may be liable for child support for the child that resulted from the sexual activity. Child support is not imposed to penalize or victimize either parent. “The purpose of child support is to provide for the needs of the child.” Macomb Co Dep’t of Social Services v Westerman, 250 Mich App 372, 377; 645 NW2d 710 (2002), citing Evink v Evink, 214 Mich App 172, 175-176; 542 NW2d 328 (1995). “Child support is not imposed for the benefit of the custodial parent, but rather to satisfy the present needs of the child.” Pellar v Pellar, 178 Mich App 29, 35; 443 NW2d 427 (1989).

    San Francisco Follies

    Isn’t it interesting that it is a city executive and not a judge who is the activist in San Francisco?  Even more interesting is the fact that so many conservative commentators are criticizing the judges who are hearing the cases challenging the mayor’s actions for taking the cautious, non-activist approach rather than jumping right in to make a big splash with a quick ruling. 

    When I was in college, a couple I knew (a man and a woman) held a marriage ceremony and thereafter lived together as husband and wife.  The only trouble was, they had never applied for a marriage license and thus the ceremony was of no legal effect.  A couple of years later, that made the “divorce” quite easy. 

    The same thing is happening in San Francisco.  A bunch of people are going through a ceremony of no legal effect, one which will not create a relationship which will be recognized anywhere.  I have a hard time getting all that worked up about it.

    Earlier this month, Nick Confessore of TAPPED wrote “In Defense of No-Name Bloggers“, responding to what he called a “very weak attack” by Salon’s Christopher Farah against those who post on weblogs under assumed names.  Confessore notes a critical distinction in correcting Farah’s reference to them as “anonymous” authors, observing:

    That’s incorrect. They’re pseudonymous, like, say, the authors of The Federalist Papers. And it’s an important distinction. Anonymous writing can indeed be poisonous, because it frees the writer from any consequences whatsoever for his ideas. . .

    Blogging continuously under a pseudonym, however, is a very different matter. Someone like Atrios or TMFTML has an intellectual identity and a reputation to defend.

    My Backword

    Peter Nordberg of Blog 702 has some favorable words about these last two postings and some thoughtful comments on the criteria that can be used to judge what he describes as the “ethics” of legal and political discourse. 

    In my series of longish postings on the “John Edwards - cerebral palsy - junk science” topic over the last three weeks,  I have made clear my disagreements with Walter Olson on certain key points on this topic, but I would be remiss if I did not observe at the same time that Olson and his colleagues with the Manhattan Institute have made major contributions to the overall topic of abuse in and abuse of the court system and its participants over the last ten years.  The Overlawyered site, in particular, continues to be a cornucopia of craziness, a fountain effusively overflowing with the fatuousness and folly that permeates our legal system.  (I watched a Dennis Miller performance last night, and I just can’t help myself.) 

    I do think that Olson’s mission is ultimately political and not legal, and thus he and his colleagues do tend to describe in terms of sharp black and white ideas and concepts that I view in shades of grey.  But that is the nature of political discourse, and that fact has to be accepted.  Olson has been very gracious in linking to my comments and in responding, and even was good-humored about the fact that I did at one point confound his own comments about Edwards with those offered in a guest editorial by his MI colleague, Jim Copland [NRO, January 26], and thereby did perhaps engage in a bit of caricature myself.  I would echo Nordberg’s thoughts on the markers of quality in discourse, and borrow from a well-worn phrase in commenting that we can disagree with those we respect, and do so without being disagreeable.
